Terms of Service

These Terms of Service ("Terms") govern your use of FaiirPe ("we," "us," or "our") and its website, applications, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

FaiirPe provides a cross-border payment facilitation platform designed for Indian freelancers, contractors, and consultants. Our services include:

  • Facilitating the receipt of international payments from global clients
  • Currency conversion from foreign currencies to INR via our licensed banking partner
  • Generation of FIRA (Foreign Inward Remittance Advice) certificates for tax compliance
  • Invoice creation and management tools

FaiirPe is not a bank, financial institution, or money service business. All payment processing is conducted through RBI-authorized banking partners.

3. Eligibility

To use our Service, you must:

  • Be a resident of India
  • Be at least 18 years of age
  • Hold a valid PAN (Permanent Account Number) card
  • Have a valid Indian bank account for receiving payments
  • Have the legal capacity to enter into binding agreements

4. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information up to date. You agree to notify us immediately of any unauthorised access to or use of your account.

5. Payment Processing

FaiirPe facilitates cross-border payments through RBI-authorized banking partners. You acknowledge and agree to the following:

  • Fees: a flat fee of $19 per invoice applies to all transactions, with no additional FX markup
  • Exchange Rates: currency conversion is performed at the prevailing exchange rate provided by our licensed banking partner at the time of processing
  • Processing Times: while we aim to process payments promptly, actual settlement times depend on banking partners and may vary
  • FIRA Certificates: generated automatically upon successful payment processing and made available through your account

Our payment processing infrastructure is powered by Xflow Pay, an RBI-authorized payment aggregator. By using FaiirPe's payment services, you also agree to Xflow Pay's Connected User Terms of Service, which govern the processing of your cross-border transactions. Xflow Pay processes your identity, financial, and transaction data solely for the purpose of facilitating your payments and meeting regulatory requirements.

6. Professional Services & Product Recommendations

FaiirPe may offer additional professional services, including but not limited to talent sourcing, employer of record (EOR) services, compliance automation, and career opportunity matching. By using FaiirPe, you acknowledge that:

  • FaiirPe may use your account and professional data to recommend relevant FaiirPe services, products, and features (such as EOR services, compliance tools, and career opportunities) that may benefit you
  • Sharing your professional profile (skills, experience, portfolio) with third-party clients or partners for talent sourcing or job matching is entirely opt-in — you can enable or disable this at any time through your account settings
  • Financial and identity information is never shared with third parties as part of talent sourcing or professional services — only professional profile data, and only with your explicit consent
  • FaiirPe does not guarantee any job placements, project offers, or specific outcomes from any professional service

7. User Obligations

By using our Service, you agree to:

  • Provide accurate and truthful information for all transactions and account details
  • Comply with all applicable Indian laws, including income tax obligations, GST requirements, and FEMA regulations
  • Not use the Service for any fraudulent, illegal, or unauthorised purposes
  • Not attempt to circumvent any security features or restrictions of the Service
  • Report all income received through FaiirPe to the appropriate tax authorities

8. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the Service are owned by FaiirPe or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content on our platform without prior written permission. Your use of the Service does not grant you any ownership rights to our intellectual property.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FaiirPe shall not be liable for:

  • Delays in payment processing caused by banking partners, network issues, or regulatory holds
  • Fluctuations in foreign exchange rates between the time of invoice creation and payment settlement
  • Any losses arising from third-party service failures, including banking partner outages or errors
  • Indirect, incidental, special, consequential, or punitive damages arising from your use of the Service

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to FaiirPe in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, including for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, any pending transactions will be processed or refunded as applicable, and your obligation to pay any outstanding fees remains.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this page and, where appropriate, through email or in-app notifications. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
